Ngati Haua is occupying their ancestral Maunga Whakakoro in the far north of Aotearoa to stop it from being alienated from the Hapu (tribe) forever. In 1992 Whakakoro was occupied in protest over Whakakoro being sold by 3rd generation farmer Frank Geddes to 4 million dollar lotto winner Robert Buchanan for $700 000.00. In 2005 He it was sold for $4.5 million to high profile property developer Kim Spencer who had intensions of subdividing Whakakoro into 33 blocks and selling those blocks off for approx 1 million dollars each but who sold it to Philip Parker. Parker was invited to Whangape Marae to introduce himself and said that he was not given any information about Ngati Haua and their claim to Whakakoro. He is currently taking legal proceedings against Kim Spencer and others that lured him into this dispute. He supports our claim to have the land returned and has cancelled the sale as a result. The financiers, bankers, Property developers are all trying to get themselves out of the financial mess they are in.
"We need to stop the mortgagee tender by first mortgagers Property Funding Ltd and brokered by Barfoot and Thompson which closes at the end of the month. We need to stop any Property developers purchasing this property and putting our way of life at risk. We need to discourage buyers from this area and tell them the truth that this land belongs to Ngati Haua. This land is your birthright handed down by our Tupuna. We will do what ever it takes to have it returned. Come and join the occupation!"

Te Maunga Whakakoro is back in the news with Ngati Haua once again having to re-affirm their kaitiakitanga and mana whenua in an attempt to stop so called property developers from desecrating the maunga and destroy the
lifestyle of Ngati Haua.

This was an unsuccessful application to prevent a caveat from lapsing.
The applicant lodged a caveat against a farm property, claiming that he had an interest in the property. The property was subject to a contract for sale entered into by the respondent with a third party. The applicant alleged that he was a beneficiary of a trust of which the registered proprietor of the property, the respondent, was the trustee. The applicant argued that the trust was a resulting trust to his hapu, arising from the Maori Land Court conversion of the title of the land from customary to individual ownership. The people who obtained those individual titles did so as trustees for the rest of the hapu, so that when the respondent's family bought the land with knowledge of the trust they too became trustees.
Alternatively, the applicant argued that even if the resulting trust did not arise when the Maori customary title was individualised, it would have arisen in favour of the individual transferors when the title was transferred to the respondent's family.
Thorp J concluded that no trust was established on either of the applicant's arguments, and that as the caveator the applicant had not discharged the onus on him to establish an arguable case or a serious question to be answered. His Honour noted that if the applicant's first argument was accepted, then every title obtained from a Maori as distinct from a Crown disposition would be subject to a resulting trust. Such trusts would be enforced by the Courts, thereby giving them broader powers than those given to the Waitangi Tribunal. Thorp J held that however wrong the individualisation of Maori customary title was, and whatever the consequences of accepting the applicant's argument might be, there was no trust in this case because there was no evidentiary basis for a constructive or resulting trust. His Honour observed that persons whose lands are made subject to caveats must be given reasonable notice of the reasons that the caveat has been lodged, and that had not been done in this case.
The application was dismissed."

i am a student of Te Wananga O Raukawa and an assignment on Ngati Haua and it's people. i myself am an desendent of ngati haua. i have only come to know of this news of whakakoro by looking through different sites, i asked others if they have any awareness of such news but they like me did not. so in sending this message i/we want to know of what we can do to awhi---
