Like everyone else, I'm disgusted by the outcome of this trial. But I'm also disgusted by the media coverage of the trials. The Sunday Star-Times runs an up-close-and-personal interview with Rickards and some appalling editorals, and the NZ Herald does a better job of reporting the details but also runs a ridiculous article on whether group sex is on the rise in NZ!? Where is the discussion that WE NEED of the distinction between consensual sex and rape? This is the distinction that the whole case turned on, and it's the distinction that makes so many rape trials end in acquittal of the accused. If we want our laws to protect women (and men) against rape, we need to find a MUCH better way of making this distinction in law.

In the wake of all this, I've been trying to find out what the legal definition of rape is in NZ, and what constitutes consent. Does anyone know? Or know where I can find out?! in or around the years 1989 -1990 ( possibly 1991) my wife recalls being raped in Sunnyside Hospital (now called Hillmorton) located in Christchurch. She is not the author of this letter as the events are too traumatic for her to talk about.

What I remember is this; she was a patient in Ferguson one ward at the time. I distinctly remember, the ward and it's position on the grounds. One day in either 1989 or possibly 1990 I arrived to visit her at that ward. The kiosk is situated in the middle of the main corridor of that ward. Upon approaching the nursing station or kiosk I was confronted by my wife. She said this to me: 'I was raped last night and I'm putting in a complaint'.

She was in an agitated and upset mood. She had a dressing gown on. At a guess the time may have been somewhere between 1 -1.30pm. This is speculation, but the time I usually visited each day. The time, place, and circumstances are stated as precisely as is possible.

Immediately after she said she was raped I suggested we get an independent doctor to carry out an medical examination. However, this idea was not followed through.

From memory, nothing further happened after we discussed a medical examination. Years later, my wife relayed to me in more detail the circumstances of the alleged rape. She claimed a Maori psychiatric nurse had taken her into a room, held a cloth or towel over her face, then proceeded to rape her. This exact story was repeated by her to me on a number of occasions, but has become reluctant to talk about it since.
